1General provisions#

These Terms govern the use of the DSK studio website, its pages, forms, materials, interfaces, media files, documents, contact buttons and other elements of the site.

By using the site, the user confirms that they have read these Terms and accept them in the version in force at the time of the visit.

2Informational nature of the site#

The site is informational, presentational and communicational in nature. Texts, descriptions of services, case studies, processes, timelines, stages, indicative pricing and other materials on the site do not constitute a public offer unless expressly stated otherwise.

3No automatic contract#

Submitting a form, using the site's contact details, moving to a messenger, or sending a request, brief, message or materials does not automatically create a contractual relationship between the user and the site owner.

Contractual obligations arise only after the essential terms have been separately agreed and, where necessary, a contract, invoice, confirmation in business correspondence or other document expressly recording the parties' obligations has been executed.

4Right to decline engagement#

The site owner may, at its discretion, choose not to respond to particular enquiries, to end communication, to decline to consider a request, not to prepare a proposal and not to take a project on, without giving reasons, unless otherwise expressly required by law or by an existing contract.

This right applies in particular in cases of inaccurate information, incomplete inputs, unlawful requests, offensive conduct, abuse of communication channels, malicious activity, knowingly unrealistic requirements, or a lack of interest in the project concerned.

5Materials and intellectual property#

All texts, images, video, graphics, site structure, design, logos, selection of materials, animations, interface elements and other results of intellectual activity published on the site belong to the site owner or are used by it on lawful grounds.

Copying, adaptation, bulk downloading, republication, commercial use, creation of derivative materials, parsing, automated data collection and any other use of the site's materials without the prior written permission of the site owner are prohibited, except where expressly permitted by law.

6User responsibilities#

• The user undertakes not to use the site for unlawful, harmful or bad-faith purposes, or in ways that infringe the rights of third parties.
• The user undertakes not to send false, misleading, technically harmful, offensive or excessive materials through the site.
• The user is responsible for the accuracy of all information they transmit through the site's forms, messengers, email and other communication channels listed on the site.
• Where the user transmits data, materials, links, media files or information about third parties, they confirm that they hold the necessary rights, permissions and grounds for such transmission.

7Limitation of the site owner's liability#

The site owner does not guarantee that the site will operate continuously, without errors, without delays, or independently of external services, browsers, hardware, communication networks, caching, blockers, VPNs, antivirus software, local restrictions and other factors outside the site owner's control.

The site owner is not liable for direct or indirect losses, lost profit, loss of data, communication failures, unavailability of external services, incorrect display of the site, delayed responses, user expectations regarding a project, or any other consequences of using or being unable to use the site, unless otherwise expressly provided by law.

8External links and third-party services#

The site may contain links to third-party websites, messengers, social networks, video hosting platforms, analytics services and other external resources. The site owner does not control the content, data processing practices, terms of use or technical availability of such resources and is not liable for their acts or omissions.

9Correspondence and proposals#

Any preliminary replies, correspondence, comments, examples, or indications regarding budget, timelines, scope of work, team composition, stages or creative solutions are estimates and preliminary in nature, unless expressly recorded in a separate agreement or other written confirmation from the site owner.

The site owner may revise preliminary estimates, the structure of a proposal, the scope of work, timelines, pricing and other parameters on the basis of new inputs, clarifications, constraints identified, technical conditions, or the absence of necessary materials from the user.

10Business reputation and protection of rights#

The site owner may record information about enquiries, technical activity and interaction history to the extent necessary to protect its business reputation, prevent abuse, confirm the circumstances of negotiations and defend its rights in the event of disputes, claims or bad-faith conduct by users.

11Changes to the site and to these Terms#

The site owner may at any time change the structure of the site, the range of materials, forms, documents, technical solutions and set of services, as well as these Terms, without prior notice to the user, unless otherwise required by law.

The current version of the Terms takes effect from the moment of its publication on the site.
